Medical Malpractice: Medical malpractice refers to medical negligence or injuries caused when a health care provider, typically a physician, fails to provide a minimal level of reasonable treatment and an individual is harmed as a result. These claims are based upon evidence that the doctor failed to act in accordance with the “reasonable standard of care” for a medical provider practicing in his or her community. Almost without exception, medical malpractice claims must be presented by offering expert testimony from a qualified physician that the care rendered fell below a reasonable standard, and that such departure from this reasonable standard caused injury to the patient. These cases frequently involve a great deal of time and expense in the investigation and presentation. Again, the recoverable losses are those described in the Personal Injury section.
